An article in the January 2007 issue of Trusts & Estates journal ranked South Dakota as the “best jurisdiction” to locate a perpetual trust. The state is one of 23 in the nation that allows perpetual trusts. The ranking was based on five criteria important to individuals and families interested in such trusts, particularly those interested in multigenerational trusts.
DEHS not only has extensive experience assisting individuals and families regarding the advisability and formation of such trusts, it has been active in evaluating and forming South Dakota law governing trusts. For example, members of the firm actively participated in and served on the Governor’s Trust Legislation Task Force, which led to various legislation creating attractive trust laws.
Both P. Daniel Donohue and Sarah Richardson Larson are Fellows in the American College of Trust and Estate Counsel and are the most active trust practitioners in the firm’s Estate Planning and Trusts practice group.
